Abstract (eng)
This master's thesis delves into the EU accession process of Bosnia and Herzegovina (BiH) and explores the challenges associated with harmonizing its legal framework for EU membership. The research aims to provide a comprehensive analysis of BiH's progress, and the obstacles encountered during its integration into the EU. Methodologically, the study includes literature review, analysis of political developments as well as legal frameworks. Beginning with an overview of the EU accession process, including the EU's enlargement policy and the legal framework governing the accession procedure, the thesis emphasizes the significance of the Stabilization and Association Agreement (SAA) and examines BiH's economic integration into the EU single market. Moreover, it assesses the fulfilment of political criteria and alignment with European standards. Focusing on the challenges associated with harmonizing the legal framework, the thesis thoroughly analyzes disparities between national laws and EU regulations. Key aspects, such as the functioning of democratic institutions, the establishment of a robust rule of law, the protection of fundamental rights, and the necessity of comprehensive public administration reform, are carefully examined. Additionally, societal challenges related to the EU integration process are taken into consideration. Drawing conclusions from the research, the thesis compares BiH's progress with that of other countries in the EU accession process and provides a comprehensive assessment of it´s current state of the accession process. It highlights BiH's achievements while acknowledging the significant challenges that remain. The thesis underscores the need for ongoing political and legal reforms to meet the criteria and standards set by the EU.
