Abstract (deu)
In der vorliegenden Arbeit geht es um die umfassende Darstellung von ehegüterrechtlichen Vereinbarungen. Das Augenmerk wurde dabei zunächst auf den Ehepakt, und dabei vor allem auf Erbvertrag und Gütergemeinschaft unter Lebenden und auf den Todesfall gelegt. Einen Schwerpunkt der Arbeit bildet jedoch die Auseinandersetzungen mit den verschiedenen Arten an Vorausvereinbarungen nach § 97 Abs 1 – 4 EheG und den unterschiedlichen Kontrollmöglichkeiten des Gerichts, je nachdem ob eheliche Ersparnisse, eheliches Gebrauchsvermögen oder die Ehewohnung den Regelungsgegenstand bilden. Auch auf die Frage von Opting-in- bzw Opting-out-Vereinbarungen hinsichtlich der Ehewohnung wird eingegangen. Auch die Unterschiede hinsichtlich Form und Kontrollmöglichkeit zur Aufteilungsvereinbarung gem § 97 Abs 5 EheG werden dargestellt. Schließlich wird das Schicksal all dieser Arten von Vereinbarungen im Falle der Scheidung sowie bei Ableben eines Ehepartners erörtert. Vor allem wird dabei versucht, die Frage nach der Anwendbarkeit des § 746 ABGB auf Vorausvereinbarungen gem § 97 Abs 1 – 4 EheG zu beantworten. Hier wird zunächst der Meinungsstand wiedergegeben und anschließend ein Argumentationsstandpunkt dargestellt. Weiters wird überprüft, wie weit die eherechtlichen Vorschriften mit jenen über eingetragene Partnerschaften übereinstimmen. Auch die grunderwerbsteuerrechtlichen Folgen von ehegüterrechtlichen Verträgen werden dargestellt. Dann wird auf die (mögliche) Gebührenpflicht nach dem GebG eingegangen, auch wird Meinungsstand und Judikatur wiedergegeben und versucht, eine mögliche Argumentation gegen eine Anwendung des § 33 TP 20 GebG auf ehegüterrechtliche Vereinbarungen zu finden. Abschließend werden ein paar praktische Tipps an den Vertragserrichter zusammengefasst.

The present paper deals with the comprehensive presentation of marital property agreements. The focus is on the marriage pact, and in particular on the contract of inheritance and community of property inter vivos and in the event of death. A main focus of the work, however, is the discussion of the different types of advance agreements according to § 97 (1) - (4) of the Austrian Marriage Act and the different possibilities of control by the court, depending on whether marital savings, marital property or the marital home are the subject of the agreement. The question of opting-in or opting-out agreements with regard to the marital home is also addressed. The differences with regard to the form and the possibility of control with regard to the partition agreement pursuant to § 97 (5) of the Austrian Marriage Act are also presented. Finally, the fate of all these types of agreements in the event of divorce as well as in the event of the death of one of the spouses is discussed. Above all, an attempt is made to answer the question of the applicability of § 746 Austrian Civil Code (ABGB) to advance agreements pursuant to § 97 Abs 1 - 4 of the Austrian Marriage Act. First, the state of opinion is presented and then an argumentation point of view is presented. Furthermore, it is examined to what extent the provisions of marriage law correspond to those of registered partnerships. The consequences under real estate transfer tax law of contracts under matrimonial property law are also presented. Then the (possible) obligation to pay fees according to the Austrian Fees Act is dealt with, the state of opinion and case law is also reproduced and an attempt is made to find a possible argumentation against the application of § 33 TP 20 Austrian Fees Act to agreements under matrimonial property law. Finally, a few practical tips for the contract drafter are summarized.
