Sexualized violence is a form of gender-based violence. Victims are predominantly female* and perpetrators predominantly male*. The legal and social discourse, particularly around sexualized violence, is shaped by victim-blaming, stereotypes, allegations of false reports, credibility issues and rape myths. Sexual criminal law reflects social values particularly through its legislative changes. The focus of this work is the question of what influence social discourses have on legal practice and to what extent sex criminal law reflects patriarchal structures. In addition to an overview of the legal situation and the procedure in sexual criminal law, the studies by Birgit Haller (Haller, 2018) on Austrian court files and Yara Hofbauer (Hofbauer, 2017) on Austrian criminal files are used for substantiation. Finally, this work contains solutions to ensure better protection against invasions in sexual autonomy.
